Recently, a new law was signed into effect governing the way marijuana dispensaries in Colorado may operate. If your Colorado dispensary doesn’t meet the requirements of this new legislation, your business may be forced to shut down, and you could even face other penalties.
Of course, the government says these new laws are a positive development because they bring legitimacy to the medical marijuana industry. They believe this increased government regulation helps to prevent fraud and shady practices, ensuring only those who truly need marijuana treatment are able to get approved for it.
But not all Colorado dispensary owners agree. With some estimates saying that at least half of the 1,100 medical marijuana dispensaries in Colorado will be forced to shut down, many are wondering if the new regulations go too far and are even possibly unconstitutional.
An Overview of Laws Governing Your Colorado Dispensary
Is your Colorado dispensary in compliance
with House Bill 1284 and Senate Bill 109? Your best bet is to read the
law to familiarize yourself further with it, but here’s a basic overview
of the new legislation.
- Your Colorado dispensary must be licensed at both the state and local level
- Your city can vote to ban dispensaries in their communities
- You aren’t allowed to run a Colorado dispensary if you’ve been convicted of a recent felony or ever of a drug-related felony
- If you’ve lived in Colorado for less than two full years, you aren’t allowed to run a marijuana dispensary
- Your Colorado dispensary must grow at least 70% of the marijuana you sell—you can’t buy more than 30% of your marijuana from wholesale growers anymore
- Dispensary must have security cameras, good lighting, alarm, and safe
- No on-site marijuana consumption is allowed
- Dispensaries may not pay physicians for writing recommendations
New Laws Impact Doctors Too
Your Colorado dispensary isn’t the only entity affected by the new legislation; doctors and patients also have new regulations they must follow. Most importantly, the doctors and patients must have a “bona fide relationship”. This requires a full physical examination and yearly follow up treatment.
The concern with all of this legislation is that it drives up costs for everyone involved and makes it more difficult for patients to obtain the treatment they’re entitled to. These are important considerations that the state will have to take under advisement soon, but in the meantime, it’s important to make certain your Colorado dispensary is fully compliant with all new laws.

Colorado’s New Medical Marijuana Regulations - Key Information

Definitions
· Medical Marijuana Center (MMC) - new term for Medical Marijuana Dispensary
· Optional Premises - new term for the growing facility part of the medical marijuana center.
· Medical Marijuana Infused Products - new term for type of mmj business that manufactures infused medical marijuana products i.e. edibles, tinctures
Key Points
· MMC’s must produce a minimum of 70% of its own medicine and cannot buy or sell any more than 30% of its own inventory.
· A person cannot be listed as primary caregiver for more than 5 patients.

· Medical Marijuana Infused Products Manufacturers must have a written contract with their MMC’s which includes how much mmj will be used for making their products. They cannot use mmj from more than 5 centers to make 1 product but can sell to any center they choose.
· MMC’s can only operate during the hours of 8:00 am and 7:00 pm on any day of the week.
These are just a few examples of what makes up HB 1284. While there seems to be a couple positive moves with in this bill, HB 1284 is still very harsh and lacks clarification in many regards. The purpose of this bill was not intended to create mixed messages or focus on money and discrimination but that’s exactly what it has done.
